We are NetNames Brand Protection Limited, a brand protection and internet monitoring company.
We have been instructed by our client, Industria de Diseño Textil. S.A. (Inditex), to take action in relation to websites that infringe our client's intellectual property rights. Please see the attached authorisation letter from our client.
Our client specialises in the manufacture and supply of fashion clothing and accessories and is the trade mark proprietor of the ZARA Spanish trademark no. 2594328 and European Community trademark no. 6511521 covering “ZARA KIDS” in classes 3, 18, 25, 35.
It has been brought to our attention that your website, Zara Kids - Ropa Infantil de Zara Kids, is using our clients’ trademark in the domain name and the source code in relation to advertising services without any authorisation.
Our client is the owner of several European “ZARA KIDS” trademarks covering, amongst other, international classes 25 and 35. Also, our client is already actively using the well-known trademark “ZARA” in Spain in connection with, but not limited to, the provision of advertising services, sales promotions, namely, retail sale services in shops or through a global communication network such as the Internet.
According to EU law, our client is entitled to take action against any unfair use of their intellectual property rightfully and lawfully and to prohibit others to use the trademark “ZARA KIDS” in connection to the same or similar goods and/or services being offered in the Spanish market, which include the use of the trademark “ZARA KIDS” as domain name or part of it.
Please kindly be advised that the inclusion of our client’s trademark “ZARA KIDS” into the domain name zarakids.net and its usage in the source code is resolving amount to infringement of our client’s trademark rights.
We kindly request you expeditiously cease and desist of any and all, present or future, unauthorized use our client’s trademark “ZARA KIDS” in the source code as well as in the domain name; and, in particular, to cancel or deactivate the domain name zarakids.net within 5 days of the date of this notice in order to prevent us contacting the webhost and registrar which could result in suspension/closure of your website.
We hope that this should cease all the misunderstandings and we look forward to your immediate correspondence and kind confirmation.
