Dear registrant,
It has come to our attention that you are owner of the domain name botashunter.net (the “Domain Name”), which features the HUNTER trade mark.
As you are aware, Hunter is the world’s premier manufacturer of Wellington style boots. Our company’s predecessor began making and selling its own distinctive version of Wellington boots in 1856. Over the years, our HUNTER brand “wellies” have been used by the British Army and the Royal Family as well as the public at large. In recognition of the exceptional quality of HUNTER wellies, Hunter was awarded a Royal Warrant from HRH The Duke of Edinburgh in 1977 and a Royal Warrant from HM The Queen in 1986. Today, with international distribution in over 30 countries, HUNTER wellies enjoy unprecedented success in the footwear industry and are among the most popular footwear products in history.
Hunter Boot Limited (“HBL”) is the owner and proprietor of the HUNTER trade mark around the world. In particular, Hunter owns the following registered Trade Marks in the territories listed below:
- Trade Mark Registration No. 249345 HUNTER (word mark) in class 25 in the United Kingdom;
- Trade Mark Registration No. 249372 HUNTER LOGO in class 25 in the United Kingdom; and
- Trade Mark Registration No. 3700788 HUNTER LOGO in class 25 in CTM.
Your use of the HUNTER Trade Mark constitutes unauthorised use of Hunter’s registered Trade Mark and is an infringement of HBL’s intellectual property rights.
In addition, HBL has a common law right to prevent third parties from passing off their services as being those of, connected with, or authorised by HBL when they are not. Your use of the HUNTER Trade Mark amounts to a misrepresentation that you are in some way connected or associated with HBL or a stockist of HUNTER wellington boots. This misrepresentation has led to confusion amongst those who access the Website.
In these circumstances, you are required to:
1. cease and desist using the HUNTER Trade Mark for any purpose in no later than 14 days;
2. confirm in writing that you have complied with paragraphs 1 and 2 within (14) fourteen days of the date of this email.
Should you fail to comply with the above requirements by the stated date, we will seek legal action without further notice to you.
